GENERAL RENTAL TERMS & CONDITIONS

Time Basis for Rates
It is our practice to charge rentals on a basis of a day, not to exceed eight hours, and a month, not to exceed 22 days, or a total of 176 working hours per month. If equipment is used for more than eight hours per day, the monthly rental shall be increased by 50% of 1/22 of such monthly rental for each additional 8 hour shift, or fraction thereof. Monthly rental rates shall not be subject to any deduction on account of any non-working time in the month, strikes, acts of God or whatsoever.

Normal Wear and Tear
Normal wear and tear is that which would be expected to result from the use of the equipment under normal circumstances, provided the equipment is properly maintained and serviced. The customer agrees to furnish experienced competent operators for this equipment and institute a daily program of service and maintenance.

Fuels and Lubricants
In all cases the customer bears the costs of fuels and lubricants.

Conditions of Equipment
The equipment is to be delivered to the customer in good operating condition, and is to be returned to the company in the same dondition, less normal wear. Where excess cleaning or repairs are necessary, customer agrees to pay for repairs, cleaning or replacements of all parts damaged by misuse and for all extraordinary damage done.

Freight Charges
All rental rates are F.O.B. the company's warehouse. The customer pays the freight or drayage charges from shipping point to destination, and return.

Rental Period
All rentals start when the equipment leaves the company's warehouse, and stops when it is returned to said warehouse.

Payment, Taxes and Insurance
Rentals are payable in advance. Rental rates are for rental of equipment only and customer shall pay and discharge any license fees, sales or use taxes, property and/or any other taxes in connection with the customers use or transportation of the rental equipment. Customer assumes the entire risk of loss from all hazards and is required to keep such machinery and equipment adequately insured to protect all interest of the company in said equipment in such amounts as company may require.

Warranty
Customer understands and agrees that the company makes no express or implied warranty that the equipment leased is suitable for any particular purpose or type of project requiring a particular level or degree of performance. Company only represents that the equipment has certain general specifications, and is delivered in good serviceable condition.
